Please read these Terms of Service ("Terms"). By using Spur Social, you agree to them.

1. Acceptance of Terms

By accessing or using Spur Social ("the App"), you confirm that you are at least 18 years old and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the App or its services.

2. Description of Service

Spur Social is a mobile application that helps users discover and connect with others nearby for spontaneous hangouts, group outings, casual events, and social experiences. Whether you’re looking for a tennis partner, dinner plans, or a night out, the App makes it easy to meet like-minded people in real time.

Key features include:

  • Check-Ins: Signal your availability and (approximate) location.
  • Event Creation & Discovery: Find or host impromptu meetups.
  • Map/Grid View: See who’s nearby at a glance.
  • In-App Chat: Coordinate plans securely.
  • Venue Promotions: Unlock discounts when hosting events at partner businesses.

The App operates on a freemium model: most features are free, with optional premium subscriptions for power users who want unlimited event access, hosting capabilities, and more.

3. User Accounts

  • Registration: You must provide accurate, current, and complete information. Phone number verification may be required.
  • Security: You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us immediately of unauthorized use.
  • Account Sharing: Each person needs a unique account—sharing or creating multiple accounts to bypass limits or for malicious purposes is prohibited.
  • Suspension & Termination: We may suspend or terminate accounts at our discretion for violations of these Terms or harmful conduct.

4. Premium Subscriptions & Payments

Details on billing cycles, payment methods, and cancellation policies are provided in-app. All subscriptions auto-renew unless canceled before the renewal date. No refunds are provided except where required by law.

5. User Conduct & Responsibilities (Code of Conduct)

To maintain a safe, respectful, and inclusive community, you agree to these rules. Violations may lead to warnings, suspension, permanent bans, or legal action.

5.1 Prohibited Activities

  1. Harassment, Bullying, Hate Speech
    • No threats, intimidation, or hate-based language.
  2. Illegal, Defamatory, or Offensive Content
    • No unlawful, defamatory, grossly offensive, or obscene content.
    • Strictly no nudity or sexually explicit material anywhere—profiles, event pages, messages, or links.
  3. Spam & Unapproved Commercial Solicitation
    • No unsolicited promotions or duplicate posts.
    • Commercial activity is only via approved venue promotions.
  4. Impersonation
    • No false identities, fake photos, or pretending to be App staff.
  5. Intellectual Property Violations
    • Only share content you own or have rights to use.
  6. Dangerous or Illegal Activities
    • No organization or encouragement of harmful stunts, self-harm, or criminal acts.
  7. Platform Abuse
    • No hacking, scraping, bots, reverse-engineering, or other interference.

5.2 Personal Safety Disclaimer

The App facilitates social connection, not safety guarantees. You assume all risks in meeting others. We recommend public venues and informing someone you trust about your plans.

5.3 Compliance with Laws

You must comply with all applicable local, state, and federal laws. Law enforcement may be notified for serious violations.

6. Content Ownership & Licenses

6.1 User-Generated Content

You retain ownership of all content you post ("User Content": events, messages, photos, profiles, etc.). By posting, you grant Spur Social a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, modify, distribute, and display your User Content in connection with operating and promoting the App.

6.2 App Content & Intellectual Property

All non-user content—App design, logos, graphics, text, software, and trademarks—is owned or licensed by Spur Social and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

7. Third-Party Links & Promotions

The App may link to or feature promotions from third parties. We are not responsible for their services or policies. Any transactions or redemptions are solely between you and the third party.

8. Termination

8.1 Termination by Us

We may suspend or terminate your account and access at any time, without notice, if you:

  • Violate these Terms or our Code of Conduct
  • Engage in unlawful or harmful conduct
  • Attempt to hack, scrape, or exploit the App
  • Provide false or misleading registration information
  • Otherwise harm our community or infrastructure

8.2 User-Initiated Closure

You may delete your account via the App’s settings or by emailing us at support@spursocial.app. We will deactivate your profile and remove associated data in accordance with our Privacy Policy.

8.3 Effects of Termination

  • Loss of Access: You can no longer log in, view content, or use premium features.
  • Data Deletion: Your User Content may be immediately or gradually removed; anonymized data may be retained for legal or analytical purposes.
  • No Refunds: Prepaid fees are non-refundable except as required by law.
  • Re-Registration Prohibited: If terminated for misconduct, you may be barred from creating a new account.

9. Disclaimer of Warranties & Limitation of Liability

9.1 “As Is” Service

The App is provided “as is” and “as available,” without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9.2 No Guarantee of Meetups or Safety

We facilitate introductions only; we do not promise that any meetup will occur, be successful, or safe. You assume all risks when interacting with others.

9.3 Limitation of Liability

To the extent permitted by law, Spur Social and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of:

  • Your use or inability to use the App
  • Content or conduct of third parties
  • Unauthorized access to your transmissions or data

Our aggregate liability will not exceed the total fees you paid in the 12 months preceding the claim.

10. Modification of Terms

  • Right to Modify: We may update these Terms at any time, at our sole discretion.
  • Notice of Changes: Material changes will be communicated via one or more of: in-app notification, email to your registered address, or prominent notice within the App or on our website.
  • Effective Date: Each update will state its “Effective Date.”
  • Review Responsibility: You should revisit these Terms periodically.
  • Acceptance by Continued Use: Continued use after the Effective Date constitutes acceptance. If you disagree, stop using the App and delete your account.

12. Reporting Misconduct

Use the in-app reporting feature to flag users, events, messages, or content that violate these Terms. We will investigate and may take action—warnings, suspensions, bans, or involving law enforcement as needed.

13. Indemnification

You agree to indemnify and hold harmless Spur Social, its officers, directors, employees, agents, and affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your breach of these Terms or applicable laws
  • Your misuse of the App or User Content
  • Claims that your User Content infringes third-party rights
  • Your negligent or willful misconduct

You will (a) promptly notify us of any claim, (b) cooperate in its defense, and (c) not settle without our written consent. This obligation survives termination.

14. Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Virginia, without regard to conflict-of-law rules.
  • Informal Resolution: Please email support@spursocial.app first to try to resolve any dispute informally.
  • Arbitration: Unresolved disputes will be submitted to binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules, held in McLean, VA.
  • Small Claims Option: Either party may choose small claims court instead of arbitration for disputes within that court’s jurisdictional limits.
  • No Class Actions: Any arbitration must be on an individual basis; class or representative actions are disallowed.

15. User-Generated Content Moderation Policy

15.1 Manual Moderation

Our moderation team manually reviews content that is flagged or randomly sampled, including:

  • Profile photos and usernames
  • Event titles and descriptions
  • Chat messages flagged via reports
  • Check-in notes and status messages

Content that violates these Terms—such as harassment, discrimination, illegal activity, or explicit material—may be removed or edited. Users who violate policies may receive warnings, suspensions, or permanent bans depending on severity and recurrence.

15.2 In-App Reporting by Users

All users can report inappropriate content or behavior via the “Report” button on profiles, events, or chat messages. Reportable issues include, but are not limited to:

  • Harassment, threats, or hate speech
  • Spam, scams, or commercial solicitation
  • Nudity or sexually explicit content
  • Encouragement of dangerous or illegal activities

Each report is reviewed promptly by our moderation team. While we cannot guarantee immediate removal, we take all reports seriously and act in accordance with our guidelines.

15.3 No Guaranteed Pre-Screening

We do not pre-screen every piece of content. Harmful or inappropriate material may appear before removal. Please report any such content to help us maintain community standards.

15.4 False Reporting

Submitting knowingly false or malicious reports is a violation of these Terms and may result in account penalties.

16. Apple App Store / Google Play Terms

If you download the App via the Apple App Store or Google Play Store, your use is also subject to their respective terms:

  • Apple: Use of the App is subject to Apple’s App Store Terms of Service and Apple’s Privacy Policy.
  • Google: Use of the App is subject to Google Play’s Terms of Service and Google’s Privacy Policy.

You acknowledge that neither Spur Social nor its affiliates are responsible for compliance with those third-party terms and that the app stores’ policies may impose additional requirements on you.
